Clause 52.37 canopy tree permit
From 15 September 2025, Clause 52.37 requires a planning permit to remove, destroy or lop a canopy tree in residential zones (excluding Low Density). A canopy tree is one taller than 5 m, with a trunk circumference over 0.5 m at 1.4 m above ground and a canopy diameter of at least 4 m. Permits generally apply to canopy trees within 6 m of the street frontage or 4.5 m of the rear boundary and on vacant land.

Many Victorian councils require a permit to remove or heavily prune a tree with a trunk circumference over 155 cm measured at 1 m above ground or if the tree is on a significant register. Removal or pruning more than 10% of the canopy often requires a permit and may incur fees and replacement planting conditions.

A permit is generally not required when pruning less than 10% of the canopy, provided the work is carried out by a qualified arborist according to AS 4373.
